These terms and conditions ("Terms") govern your use of the website, web app, and mobile app (collectively referred to as the "Service") provided by Flare Aviation Limited ("Company", "we", "us", "our", "Flare" or "Flare Aviation"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Service.
2.1. Eligibility: You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years old.
2.2. License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use - unless otherwise specified.
2.3. User Accounts: You may be required to create a user account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.1. User Content: We may use content provided by you, such as reviews, on our website, apps or promotional material. By using our services you agree to this and understand that there will be no royalties or other reimbursement for using these.
3.2. Currency of Information: We endeavour to maintain the currency of information, particularly in respect to the learning materials and syllabuses for each module. However, we will not be held liable for any incorrect or out-of-date information. Should you suspect any information needs updating, please contact us at support@flareaviation.co.nz.
By using the Services, you accept the above.
4.1. Ownership: All intellectual property rights in the Service, including but not limited to copyrights, trademarks, and trade secrets, are owned by the Company, unless specified.
4.2. Copyright Policy: We respect the intellectual property rights of others and expect users to do the same. If you believe that your copyrighted work has been infringed, please contact us.
5.1. Privacy Policy: Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and disclose your personal information. By using the Service, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
6.1. No Warranty: The Service is provided on an "as-is" and "as-available" basis, without any warranties of any kind, express or implied. We do not warrant that the Service will be error-free or uninterrupted.
7.1. Exclusion of Damages: In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to the failure to pass examinations.
7.2. Provision of Services: We aim to keep our Services available at all times, though there may be unexpected or planned outages. Where possible we will communicate these ahead of time. We will consider reimbursement of subscription fees where there has been a significant outage but this will not apply to modules purchased outright.
7.3. Continuance of Services: We in no way guarantee the unlimited continuance of the Services past the given subscription term, or past three months for modules purchased outright, if the Company no longer continues to provide the Services. There will be no reimbursement for modules purchased outright in this circumstance.
8.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of laws principles.
9.1. Modification: We reserve the right to modify or update these Terms at any time, without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.

Purchases can be made via the web, Play store or App store. A purchase made on any of the three platforms will be able to access the content across any of these platforms.
There may be limitations to the number of devices you can log in with, to prevent unauthorised sharing of logins. If restrictions are put in place, you can contact us to unlock and add different devices.
If you purchase a module outright, it gives you unlimited access to the module and any updates. This could be subject to change without notice, but at minimum you will always get access for at least as long as the equivalent subscription cost.
Subscriptions can be made via any of the three platforms; the web, Play store or App store.
Subscriptions can only be cancelled in the same place they were made (i.e. must be cancelled on the web for subscriptions started on the web) or by contacting support@flareaviation.co.nz.
Note that there may be a 48 hour delay before cancellations are processed by email, depending on how quickly we are able to respond.
We offer a free trial to allow you to experience Flare before purchase. Due to this we generally do not offer refunds once a purchase or subscription is made.
If you would like to request a refund for any reason, please contact support@flareaviation.co.nz with the reason and we will consider this and respond as soon as possible.
If you have a subscription a minimum of two months and forget to cancel it after you have finished, you can email us within 48 hours of a payment and we will review to see if we can process a refund for the latest payment. This will be done at our discretion.
It is your responsibility to ensure the subscription is maintained or cancelled as required.
